ORDINANCE NO. 186-26

AN ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF ANDERSON, TEXAS, ADOPTING A COMPREHENSIVE ZONING ORDINANCE AND OFFICIAL ZONING MAP FOR THE TOWN OF ANDERSON; ESTABLISHING ZONING DISTRICTS AND REGULATIONS GOVERNING THE USE OF LAND AND STRUCTURES WITHIN THE TOWN; PROVIDING FOR INTERPRETATION, ADMINISTRATION, ENFORCEMENT, AND AMENDMENT OF THE ZONING ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING A REPEALER; PROVIDING FOR OPEN MEETINGS COMPLIANCE; AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, the City Council of the Town of Anderson, Texas, finds that zoning regulations adopted in accordance with a comprehensive plan will promote the public health, safety, morals, and general welfare of the Town; and

WHEREAS, the Town has prepared and considered a comprehensive plan and a proposed zoning ordinance and official zoning map for the orderly growth, development, redevelopment, and preservation of the Town; and

WHEREAS, the City Council is acting as authorized by Texas law without appointment of a zoning commission; and

WHEREAS, the City Council conducted the public hearing(s) required by law after providing all notices required by applicable law; and

WHEREAS, the City Council finds that adoption of the zoning ordinance and official zoning map is in the best interest of the Town and its citizens;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF ANDERSON, TEXAS, THAT:

SECTION 1. FINDINGS.

The recitals set forth above are incorporated into this Ordinance as findings of fact as if fully set forth herein.

SECTION 2. ADOPTION OF ZONING ORDINANCE.

The document attached hereto as Exhibit ”A” and incorporated herein for all purposes, entitled ”Town of Anderson Zoning Ordinance,” is hereby adopted as the official zoning ordinance of the Town of Anderson, Texas.

SECTION 3. ADOPTION OF OFFICIAL ZONING MAP.

The document attached hereto as Exhibit ”B” and incorporated herein for all purposes, entitled ”Official Zoning Map, Town of Anderson, Texas,” is hereby adopted as the official zoning map of the Town of Anderson, Texas. The zoning district boundaries shown on Exhibit ”B” are hereby established and shall govern the use of land and structures within the Town, subject to the terms of Exhibit ”A.”

SECTION 4. APPLICATION.

From and after the effective date of this Ordinance, the use of land, buildings, and other structures within the Town of Anderson shall confor111 to the district regulations, development standards, use regulations, administrative procedures, and other requirements set forth in Exhibit ”A,” as amended from time to time.

SECTION 5. ADMINISTRATION AND ENFORCEMENT.

The Town officials designated in Exhibit ”A” are authorized and directed to administer and enforce the zoning ordinance and official zoning map according to their terms and applicable law.

SECTION 6. REPEALER.

All ordinances, resolutions, rules, or parts thereof in conflict with this Ordinance are hereby repealed only to the extent of such conflict.

SECTION 7. SEVERABILITY.

If any section, subsection, sentence, clause, phrase, or provision of this Ordinance, or its application to any person or circumstance, is for any reason held invalid or unconstitutional, the remainder of this Ordinance shall nevertheless remain in full force and effect, and the City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, sentence,

clause, phrase, and provision hereof, irrespective of the fact that any one or more portions may be declared invalid.

SECTION 8. OPEN MEETINGS.

It is hereby officially found and determined that the meeting at which this Ordinance was adopted was open to the public, and that public notice of the time, place, and purpose of said meeting was given, all as required by law.

SECTION 9. EFFECTIVE DATE.

This Ordinance shall take effect immediately upon its passage and adoption, subject to any publication, filing, or other post-adoption requirements imposed by law.
