The Board of Aldermen of the Town of Anderson met in regular open session in the American Legion Building in Anderson, Texas, at 7:00 p.m. Thursday, February 9, 2012. Present were Mayor Gail Sowell, Alderwomen Erna Freeman and Carol Debose; Aldermen Daryl Alford, Tom Johanson, Joe Boudreaux and Attorney Angela Collier.
Guests in attendance for the meeting were Cindy Bell, Chester Finke, Clint & Kim Capps, Janet Nevill, Kyle Childress, Dorothy Holtkamp, Collette Schelsteder and daughter Bailey and Billy Bean.
The meeting was called to order at 7:00 p.m.
Kyle Childress, Pastor of Anderson Baptist Church, addressed members about a planned building program and assistance they needed in determining the distance the city allowed along the property lines for easements. He asked for a letter from the city explaining the guidelines to go by. Mayor Sowell will check into the matter and send the letter to the Baptist Church.
Collette Schelsteder, representing the Ranch Hands 4-H Club from several surrounding communities, addressed the members regarding a car show fundraiser they want to put on during Stagecoach Stopover on May 12. They have received permission from the A-S CISD to use the parking lot of the vacant elementary school. Alderman Johanson made a motion to approve the show; Alderwoman Freeman seconded the motion. All members present voted in favor of the motion.
Mayor Sowell asked that minutes from the regular meeting held on Thurs., Jan. 12, 2012 be approved. Alderman Tom Johanson made a motion to approve the minutes as presented; Alderman Joe Boudreaux seconded the motion. All members present approved the motion.
Mayor Sowell asked members to consider/approve adoption of Ordinance No. 87-12 calling for an election to be held in Anderson on Saturday, May 12, 2012. There are three positions of 2-year terms up for election. Those being Alderman positions held by Daryl Alford, Erna Freeman, and Joe Boudreaux.
She asked their consideration/approval of an agreement between the Town of Anderson and the Anderson-Shiro CISD to hold a joint election per state statute.
The Mayor also asked for the consideration and approval of an agreement between the Town of Anderson and the County of Grimes authorizing the Election Administrator Becky Duff to conduct the election. Alderman Tom Johanson made a motion to approve these three requests; motion was seconded by Alderman Alford and approved by all members.
Mayor Sowell asked members to consider/approve allowing the Town of Anderson to be a sponsor for the 2012 Gimes County Relay for Life to be held in Anderson on May 11 & 12th. Alderman Alford made a motion that the town sponsor the event at the Silver Level of $500.00. Alderman Boudreaux seconded the motion; all members present voted in favor of the motion.
Mayor Sowell advised members that the Master Gardners have asked for a letter signed by members and the Mayor allowing them to officially begin work. They will get with Jim Westmoreland, president of the Grimes Co. Greys to see if they can use their electrical and water hookups
City Attorney Angela Collier provided an update on the progress of condemnation properties. Regarding the Peavy property, she is working with Navasota’s City Attorney. At this time no one is working on issues due to the Supreme Court decision passed recently in Dallas. She will be attending a workshop on April 6 which hopefully will provide more information. Alderwoman Freeman asked if the court order could go forward but Alderman Alford said he felt we should wait until after April 6 to proceed. Next scheduled Board meeting is April 12.
Regarding Mr. Bean’s property. She had spoken with Mr. Malek regarding his letter and the issues it presented for Mr. Bean. There was much discussion on the issue stressing the “non-compliance” by Mr. Bean resulting in a “breach of contract”. Alderman Boudreaux made a motion that the city go forward with a Breach of Contract suit against Mr. Bean. Alderwoman Freeman seconded the motion. Attorney Collier was asked to proceed with the process.
Mayor Sowell asked members to consider/approve payment of all accounts currently due and payable. Alderman Johanson made a motion to pay the bills, Alderman Alford seconded the motion. All members present voted in favor of the motion.
