BE IT REMEMBERED that on this the 12th day of December 2024, at 7:00 p.m., there was begun and holden a Regular Meeting of the Town of Anderson, Grimes County, Texas.

 

  1. Call the meeting to order and establish a quorum. At 702pm delay due to school event overflow in the parking lot. Members present Kason Menges, Tanner Krause, Bessie White, Mayor Marc Benton, Town Clerk Rebecca Ray. Harold Minor arrived at 7:05pm. Visitors present Sherri Benton.
  2. Invocation given by Kason Menges.
  3. Pledges to the flags.

“Honor the Texas Flag. I pledge allegiance to thee, Texas, one state under God, one and indivisible.”

  1. Public Comment No public comment.
  2. Mayor’s Update
    1. RCP Survey needs to be pushed out to get a few more inputs before it is closed out.
    2. Meeting on January 8th 2025, the day before the Regular Meeting to gather events for the year 2025 and place in calendar format.
    3. BVR has increased their rates. There will be a discussion to have a single Utility bill that includes trash pickup. Will get more information.
    4. Mayor Marc Benton just had lunch with Sarah Borowicz, Martha Smith in place for Sheriff Don Sowell and Joe Fauth. It will be a quarterly gathering to go over and discuss Anderson government. This discussion involved being interested in sidewalks and a joint letter to TxDOT for FM 149 roadwork.
  3. Consent Agenda: Motion to approve all Consent Agenda Items by Kason Menges, Second by Tanner Krause, all in favor for the entirety.

All consent items are considered to be routine and will be enacted by one motion and vote.

  1. Permit report:
    1. Three vendor permits and one construction permit for the fire department this month.
  2. Sewer Report:
    1. No Update
  3. Grants Report
    1. 2017 Harvey Grant:
      1. Still not closed out.
      2. In 2021 Bleyl Engineering sent an invoice. The invoice either was not paid or was paid from another account. This is being looked into.
    2. ARPA Grant:
      1. Allocated remaining amount to Bleyl Engineering.
  • 2023-2024 CDBG:
    1. Lift stations need work, and the Town of Anderson will be looking for contractors.
    2. Review bids next month.
  1. 2025-2026 CDBG:
    1. Mayor Marc Benton made the application on Monday.
  2. CDBG MIT-MOD:
    1. No Update.
  3. Harvey Reallocation Funds:
    1. RFI flood plain map has been sent and paperwork being evaluated.
  • RCP:
    1. Survey is underway and still needing to be pushed out to the community.
  1. Texas Department of Transportation (TxDOT):
    1. Mayor Marc Benton called James yesterday. Main Street update was discussed.
    2. Called to get an update and after the survey, the results were modified.
  2. Business:

Discuss, consider, and possibly take action regarding:

  1. Consider and take action regarding the creation of an Anderson Municipal Development District including, but not limited to, potential candidates for initial Board of Directors, tax rate to be imposed, and calling for an election in May of 2025.
    1. Propose to create an MDD. An MDD would be created to bring new businesses and support current businesses in the Town of Anderson.
    2. Bring names to the council, then there will be a vote for five people for the board of directors. The board members do not need to be residents within the Town of Anderson limits.
  • A Meeting will be held then bi laws will be passed. All done by February 14 and following vote to put sales tax on the May ballot.
  1. Paperwork provided by Marc Benton.
  2. Kaons Menges makes a motion to pursue the creation of a Town of Anderson Municipal Development District that would require five council approved members and an election to implement a special sales tax usage of .25% toward the MDD. Second by Tanner Krause, all in favor.
  1. Consider and take action to approve the purchase of a replacement oven in the Town Hall.
    1. Options given by Rebecca Ray.
    2. Prices range from $600 to $1600 with one option of a donation.
  • Kason Menges motion to approve Thor oven 48in for donation, second by Tanner Krause, all in favor.
  1. Consider and take action to engage in negotiations with Grimes County for the potential purchase of the park located on S. Main Street (R20453 on Grimes CAD). It is anticipated that the Council will conduct an Executive Session in accordance with Section 551.072, Texas Government Code, deliberation regarding purchase, exchange, lease, or value of real property located within the limits of the Town of Anderson.
  1. Executive Session at 7:29pm
    1. Convene into Executive Session pursuant to Sec. 551.072, Texas Government Code, to deliberate the sell, purchase, exchange, or value of certain real property located within the limits of the Town of Anderson.
  2. Possible Action from Executive Session at 8:16pm.
    1. Reconvene into public session and take action as appropriate at the discretion of the Town Council regarding the sell, purchase, exchange, or value of certain real property located within the limits of the Town of Anderson.
    2. Kason Menges makes a motion to approve negotiations by the Mayor with the Town Attorney acting as advisory to pursue the purchase of GCAD lot R20453 and GCAD lot R20379 from Grimes County, SECOND BY Tanner Krause, all in favor.
  3. Around Town
    1. The mobile home at the end of Houston Street, the sewage line issue previously discussed. There needs to be a ten-day letter for a plumber to come out. This is the resident’s responsibility.
    2. Streetlight is out on Main Street north at the end.
    3. The after-school program is underway. It will include leadership and tutoring.
    4. Mailbox height and culvert guidelines requested from residents.
    5. Anderson Baptist shutting down Johnson Avenue Sunday night from 6pm-8pm for a Christmas event.
  4. Discussion of agenda items for the next scheduled meeting
    1. An ordinance for engine breaks and check breaks.
    2. Grass height ordinance 95-13 was discussed.
