BE IT REMEMBERED, that on this the 11th day of April 2024, at 7:00 p.m., there was begun and holden a Regular Meeting of the Town of Anderson, Grimes County, Texas.

1. Call meeting to order and establish quorum at 7pm Members present Tanner Krause, Rebecca Ray, Mayor Marc Benton, Daryl Alford, Harold Minor. Members absent Kason Menges and Bessie White. Visitors present Sophia Devine, Miles Devine, Deward Hales, Cathy Hamilton, Richard Hamilton and Sarah Borowicz.
2. Invocation given by Harold Minor.
3. Pledges to the flags.
“Honor the Texas Flag. I pledge allegiance to thee, Texas, one state under God, one and indivisible.”
4. Public Comment no public comment
5. Mayor’s Update
a. Spring cleanup April 27th. Need to reach out to the county for support, dumpster is scheduled. The trailer on the corner of main and FM 1774 needs to move before the event from 8am to noon.
b. April events. Candidate Forum Wednesday April 17th. Begins at 6:30pm and ends by 8pm approximately. The historical commission will be at the park October 5TH. If vendors are in the street, they will need a permit and if they are on the property they will need no permit. If there are any issues with three in a row Christmas events, let Mayor Marc Benton know. Fanthorp using park May 13th for mock election using history figures. Fiber optics call with GrantWorks. Providers need to apply for grants. Needs county-initiated project. Would like the municipalities of Grimes County to get on board regarding broadband. Needs officials and businesses in the community. Pertaining to road repairs, hill street potholes, Austin manhole cover and culvert on Pecan taken care of. Has recommended Austin and Cedar be the next locations to address. Calls from numerous potential homeowners and developers requesting codes. Interested in subdivisions possibly and requesting opinions from the council. Areas in town to address and need to send letters for non-compliance. Here to serve the community as representatives. Always open for concerns and issues. TML cyber security training email will be sent soon have finished by august 23rd.
6. Consent Agenda:
All consent items are considered to be routine and will be enacted by one motion and vote.
a. Approval of the March 14, 2024, Town Council Special Meeting Minutes change name to Justin motioned by Tanner Krause, seconded by Daryl Alford, all in favor.
b. Approval of the list of claims and bills motioned by Tanner Krause, seconded by Daryl Alford, all in favor.
7. Reports:
Informational reports only, no action to be taken.
a. Permit report no action 1 food vendor Cousins Maine Lobster, and a residential permit.
b. Sewer Report no updates.
c. Grants Report
i. 2017 Harvey Grant no update
ii. ARPA Grant Caitlyn be here April 16th for annual report, working with Vicki to get paperwork updated.
iii. 2023-2024 CDBG no update
iv. CDBG MIT-MOD
v. Harvey Reallocation Funds
vi. RCP requesting FY22 audit. May be delays for required for documentation.
d. Texas Department of Transportation (TxDOT) talked with TxDOT, Highway 90 project scope of work complete except final negotiations. Expects by end of month but stating publicly by the end of next month.
8. Business:
Discuss, consider, and possibly take action regarding:
a. Consider and take action to approve execution of Professional Services Contract for On Call Services with Bleyl Engineering and authorize the mayor as signatory. Allows the Council to contact when needed and necessary. Motioned by Tanner Krause, Seconded by Harold Minor, all in favor.
b. Consider and take action to approve using item A above, if approved, to have Bleyl Engineering review and provide recommendation on Grimes County’s request for variance of ordinance 153-22 and pass the costs back to the County. Unbudgeted item county asking for council to look into. Will talk to the county regarding costs. Received response from Attorney James Parker. Next month agenda modify ordinance. Table to next month until variance procedure and ordinance is discussed. The council questioned if they would like to pursue it. Have Brian or Steve look into the numbers. Need more flow in summer when its dry stated by Daryl Alford. Harold agreed to have a discussion with Brian. Line H refers to what’s in question in the variance. Will be discussed in next month’s meeting.
c. Consider and take action to approve execution of Engagement Letter with Taylor Boeker, CPA to conduct our FY2022 audit and authorize the mayor as signatory. Motioned to approve and sign letter by Tanner Krause, seconded by Daryl Alford, all in favor.
d. Consider and take action to adopt Resolution 114-24 Policies and Procedures Applicable to All Procurements Made with Federal Funds and authorize the mayor as signatory. Mayor Marc Benton read aloud Resolution 114-24. RFI for RCP grant new policy and procure for procurement to use funds. Reference to town charter was removed. Motioned to approve by Tanner Krause, seconded by Harold Minor, all in favor.
9. Executive Session at 742pm.
a. Convene into Executive Session pursuant to Sec. 551.072, Texas Government Code, to deliberate the sell, purchase, exchange, or value of certain real property located within the limits of the Town of Anderson.
b. Convene into Executive Session pursuant to Sec. 551.072, Texas Government Code, to deliberate personnel matters.
10. Possible Action from Executive Session back to public meeting at 8:06pm.
a. Reconvene into public session and take action as appropriate at the discretion of the Town Council regarding the sell, purchase, exchange, or value of certain real property located within the limits of the Town of Anderson.
b. Reconvene into public session and take action as appropriate at the discretion of the Town Council regarding personnel matters.
11. Around Town any updates from Wanda Creeks? Request to remind by Harold Minor. Cleaned up west Buffington. Finally getting people in Anderson. Look at streets for importance for fixing. Hill Street, Houston and Cedar mentioned for road repairs.
12. Discussion of agenda items for the next scheduled meeting. Quote for roadwork, variance in this agenda. Results for May 11th for election. Meeting in June for new council members at a Regular Council Meeting.
13. Adjourn motioned by Tanner Krause, seconded by Daryl Alford, all in favor at 8:13pm.
