Ordinance 172-25
ORDER CALLING ELECTION TO ADOPT A LOCAL SALES AND USE TAX WITHIN THE TOWN OF ANDERSON
Whereas, the Town of Anderson has experienced rapid growth in recent years and anticipates further, rapid growth in the future; and
Whereas, in accordance with section 321 of the Texas Tax Code, the Town Council of the Town of Anderson desires to adopt a local sales and use tax of one-quarter of one percent (.25%) for all areas located within the boundaries of the Town of Anderson; and
Whereas, to the extent known by the Town Council of the Town of Anderson, the Town of Anderson does not collect a local sales and use tax within the Town of Anderson; and
Whereas, the Town of Anderson is a Type-B Municipality as described in Chapter 7 and Sec. 5.002 of the Texas Local Government Code; and
Whereas, the Texas Local Government Code provides that a Type-B Municipality may impose a local sales and use tax of up to .25%; and
Whereas, if the election is successful, a local sales and use tax not to exceed .25% will not violate Section 321 of the Texas Tax Code; and
Whereas, if the election is successful, the revenue generated shall be deposited in the General Fund for costs associated with business development, road improvements and other expenditures necessary for the benefit of the Town of Anderson; and
Whereas, the Town Council of the Town of Anderson wishes to proceed with the ordering of an election for May 3, 2025, the next available uniform election date, and appointing election officials required for the conduct of the election, and has deemed it advisable to call the election hereinafter ordered; and
Whereas, the meeting to adopt this Order was open to the public, and public notice of the time, place, and purpose of the meeting was given, all as required by Chapter 551, Texas Government Code, as amended.
THEREFORE, BE IT ORDERED BY THE TOWN COUNCIL OF THE TOWN OF ANDERSON, TEXAS:
- The matters and facts set out in the recitals of this Order are hereby found and declared to be true and complete;
- That an election is ordered for the purpose expressed above to be conducted as stipulated in the attached ORDER OF ELECTION which is made part of this ordinance.
